Statutory alert: 2016 amendments to the Maritime Labour Convention, 2006, as amended.

Applicability: All shipowners and ship managers

At the 105th annual meeting of the International Labour Conference, amendments were voted for regarding the protection of seafarers against shipboard harassment and bullying and to allow for an extension of the validity of flag state issued maritime labour certificates.

For the majority of states that have ratified the Maritime Labour Convention, 2006, the entry into force date for the 2016 amendments will be 8 January 2019. For Chile, the Maritime Labour Convention, 2006, as amended, comes into force on 22 February 2019.

The following countries have still to submit the declaration of acceptance of the 2016 amendments to the International Labour Office: Albania, Indonesia, Jamaica, Lebanon, Slovakia and Tunisia.

Shipowners and ship managers are advised to review their management systems to ensure they include procedures for the elimination of harassment and bullying on board ship and reference the procedures in the DMLC Part II.
