Who Owns the Value of Efficiency? Beyond Fuel Saving: The Commercial Battle for FuelEU Surplus Revenues, Zero-emission Fuel Incentives and Emerging Decarbonisation Values

For decades, shipping has wrestled with the same challenge: one party invests, another captures the benefit. Today, that challenge is becoming even more complex. FuelEU pooling, compliance surpluses, wind-assisted propulsion and proposed ETS-backed funding mechanisms are creating new sources of value that extend far beyond fuel savings. Efficiency is no longer just a technical improvement. It is becoming a strategic and tradable asset. At the same time, new compliance markets and commercial models are emerging around decarbonisation. Revenues, incentives and compliance benefits can now be created, traded and shared across multiple stakeholders, raising new questions about who captures value and who assumes the risk. Yet many of the industry's existing commercial arrangements were not designed for this new reality.


Shipowners may make the investment, while charterers, operators or other stakeholders receive much of the benefit. Unless commercial incentives can be aligned, many of the technologies needed to accelerate maritime decarbonisation may struggle to achieve scale. This session brings together legal experts, shipowners, charterers, fuel suppliers and compliance market makers to debate one of the most important commercial questions facing the industry. From FuelEU surplus revenues and compliance pooling to alternative fuels, wind-assisted propulsion and ETS-backed incentives, the discussion will explore how value should be allocated, how contracts may need to evolve, and what commercial models can unlock investment across the maritime value chain. If decarbonisation creates value, who deserves the reward?
